General Terms and Conditions
1. General
The following General Terms and Conditions apply to all contracts, deliveries and other services provided by GenericFilter.com. We hereby expressly object to any conflicting terms and conditions of the contractual partner. Any special agreements deviating from these terms shall only be binding if confirmed in writing.
2. Delivery
The ordered items are normally shipped by Swiss Post or a freight carrier.
As a rule, delivery is made against advance payment. Delivery on invoice can only be offered following a successful credit check. Shipping is free of charge for orders with a goods value of CHF 49 or more. For orders below CHF 49, a small order surcharge of CHF 9 applies.
The delivery times can be found on the respective product pages.
If the delivery deadline is not met, the buyer is entitled to set a reasonable grace period in writing (by email or letter post), including a notice of refusal, and may withdraw from the order after this period has expired. Exception: customer-specific special orders.
If the delay in delivery is due to the inability of the manufacturer or our supplier, both GenericFilter.com and the buyer may withdraw from the order if the agreed delivery date is exceeded by more than 30 days.
Claims for damages due to delay in delivery, impossibility or non-performance of the contract, including those arising up to the withdrawal from the order, are excluded unless a legal representative of GenericFilter.com has demonstrably acted intentionally or with gross negligence.
3. Technical information
All technical information, data and measurements are based on information provided by the relevant manufacturers and/or external testing bodies and/or our own measurements. Such technical information does not constitute any guarantee by GenericFilter.com regarding specific product characteristics. No liability is accepted for any printing or transmission errors.
4. Prices
All prices are quoted in Swiss francs (CHF), including value added tax (VAT), plus shipping costs for transport, packaging and insurance where applicable. Price errors and changes are reserved. The price valid on the order date shall apply.
5. Payment
The following payment methods are available to all customers as advance payment:
E-banking (bank transfer), Visa, Mastercard and PayPal.
Purchase on invoice: purchase on invoice is subject to a credit check. In the event of a negative decision, orders can only be placed via e-banking, PayPal or credit card.
The payment term is 30 days from the invoice date.
In the event of payment default after two written reminders, the claim will be assigned to our debt collection partner. Additional costs will be charged in accordance with www.fairpay.ch.
6. Retention of title
The delivered goods remain the property of GenericFilter.com until the outstanding invoice amount has been paid in full.
7. Returns and complaints
Please inspect the delivered goods immediately upon receipt for completeness, correctness and any visible damage. Transport damage, incorrect deliveries or obvious defects must be reported to us in writing immediately after receipt.
No returns in the case of correct delivery
- No returns in the event of dissatisfaction
- No returns in the event of incorrect orders
- No returns of opened or used consumable items
- No returns of filters, vacuum cleaner bags, water filters, batteries and comparable consumable items if delivered correctly
Complaint in the event of damaged, defective or incorrectly delivered goods
If goods are delivered damaged, defective or incorrectly, this must be reported in writing immediately after receipt. After reviewing the complaint, we will, at our discretion, provide a replacement delivery, repair, credit note or refund, insofar as statutory warranty claims apply.
Returns will not be accepted without prior notification and approval from our customer service team.
8. Warranty and claims for defects
No voluntary warranty is granted for the consumable products offered.
Mandatory statutory claims in the event of goods delivered damaged or proven to be defective remain unaffected. Such complaints must be reported in writing immediately after receipt of the goods, stating the order number.
A claim only exists if the goods were used as intended and no defect is present that is attributable to improper handling, external influences, normal wear and tear or storage by the customer.
If there is a justified defect reported in due time, the matter will be handled, at our discretion, by replacement delivery, credit note or refund of the purchase price. Any further claims are excluded to the extent permitted by law.
9. Liability
In the event of defective goods, they will, at our discretion, either be replaced free of charge with new defect-free goods or repaired. The right to rescission and price reduction is excluded. Any further claims are excluded. Our advice is provided to the best of our knowledge, but without warranty. With regard to losses and damage caused by the freight carrier, the customer has no claims against GenericFilter.com.
The customer is responsible for the selection and use of the products. Claims for damages of any kind are excluded unless GenericFilter.com caused the damage intentionally or through gross negligence. No liability is accepted for consequential or indirect damages.
10. Place of jurisdiction
The business activities of GenericFilter.com are governed exclusively by Swiss law. The place of performance and jurisdiction is Nidau (Canton of Bern).
